Terms of Service
These terms apply to your use of the M5wallet applications, this website and the related services.
This document was drafted in good faith for a self-custodial wallet and follows common practice in this sector, but it has not been reviewed by a lawyer and two items are still unset: the legal entity that publishes M5wallet, and the governing jurisdiction. Have counsel complete and review it before launch.
M5wallet is published by [LEGAL ENTITY NAME AND REGISTERED ADDRESS — to be completed].
The English version of this document is the authoritative one. Translations are provided for convenience; if they conflict, the English text governs.
Acceptance and eligibility
By installing or using M5wallet you agree to these terms. If you do not agree, do not use it. You must be at least 18 years old and legally capable of entering into a contract. If you are using M5wallet on behalf of an organisation, you confirm you are authorised to bind it.
Self-custody
M5wallet is self-custodial. We do not hold your assets, we cannot move them, and we cannot freeze or reverse a transaction you have signed. Because signing requires both shares of your vault, we cannot sign on your behalf, and equally we cannot recover access for you if you lose your ability to take part in the ceremony. There is no support process that can restore a lost vault.
Licence and intellectual property
You are granted a personal, non-exclusive, non-transferable, revocable licence to use the software for its intended purpose. The M5wallet name, logo and branding remain ours. This licence does not transfer ownership of anything. Portions of the software are provided under open-source licences, and where those licences grant you broader rights than these terms, those licences apply to those portions.
Your responsibilities
You are responsible for keeping your vault backup and your Fast Vault password, for the security of the devices you use, and for reviewing what you approve. Approving a transaction is irreversible once it is broadcast, regardless of what prompted you to approve it.
Beta software
Pre-release builds are provided for testing. They may contain defects, may be replaced or withdrawn, and may lose data between versions. Do not rely on a beta build to hold assets you cannot afford to lose.
Prohibited use, sanctions and export control
You must not use M5wallet to break the law, to launder money or finance terrorism, to evade sanctions, or to interfere with, reverse-engineer for circumvention, or attack the software or our services. You confirm that you are not located in, and not a resident of, a jurisdiction subject to comprehensive sanctions, and that you do not appear on any applicable restricted-party list. Because the wallet is self-custodial we do not hold your assets and cannot freeze or seize them; that is precisely why compliance is your responsibility.
No financial advice
Nothing in the applications or on this website is investment, tax or legal advice, an offer to sell, or a solicitation to buy any asset. Any price displayed for the M5L token inside the application is a configured reference value, not a market price; M5L is not listed, and no market capitalisation, trading volume or return should be inferred from it. Digital assets are volatile and you can lose everything you put in.
Taxes
You are solely responsible for determining what taxes apply to your transactions and for reporting and paying them. We do not provide tax advice and do not report on your behalf.
Third-party services and networks
The wallet interacts with blockchain networks, swap providers, trading venues and decentralised applications operated by others. We do not control them and are not responsible for their behaviour, availability, fees or losses arising from them. Connecting to a decentralised application is your decision.
Availability
We do not guarantee that our services will be uninterrupted. A Fast Vault requires our co-signer service to be reachable in order to sign; if uninterrupted independent access matters to you, use a Secure Vault, where both shares are yours.
Disclaimer and liability
The software is provided as is, without warranties of any kind to the extent permitted by law. To the fullest extent permitted by law, we are not liable for lost assets, lost profits, or indirect or consequential damages arising from your use of the software, including losses resulting from lost backups, compromised devices, or transactions you approved.
Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising out of your use of the software, your breach of these terms, or your violation of any law or third-party right.
Termination
You may stop using M5wallet at any time. We may suspend or discontinue any of our services, or stop distributing a build, at any time. Because the wallet is self-custodial, ending your use of our services does not affect your ability to sign with a Secure Vault, where both shares are yours — but a Fast Vault depends on our co-signer, so keep a backup that does not rely on us.
Governing law and disputes
These terms are governed by the laws of [GOVERNING JURISDICTION — to be completed], without regard to conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over disputes, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings locally. Nothing in these terms limits rights that cannot be limited by law.
Miscellaneous
If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a reorganisation or transfer of the business. These terms, together with the Privacy Policy, are the entire agreement between us about the software. Neither party is liable for failure to perform caused by events beyond its reasonable control.
Changes
These terms may be updated. Continued use after an update means you accept the revised terms.
